Terms of Service

Acceptance of terms

By creating an Inviato account, you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Inviato. These Terms form a binding agreement between you ("you", "your") and Polsia Inc. ("Polsia", "we", "our").

Service description

Inviato is an AI-powered autonomous outbound sales agent. It automates prospect discovery, email personalization, outreach sending, and follow-up scheduling for B2B sales teams. The service operates continuously, 24 hours per day, 7 days per week.

Account terms

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 18 years old to use Inviato. One person or entity may not maintain more than one free trial account.

You may not share your account with others. You must notify us immediately of any unauthorized use of your account.

Acceptable use

Inviato must be used in compliance with applicable laws and these Terms. Specifically, you agree NOT to use Inviato to:

• Send unsolicited commercial email in violation of CAN-SPAM, GDPR, CASL, or local equivalents
• Target individuals without their consent or in ways that constitute harassment
• Process personal data of EU residents without a valid legal basis under GDPR
• Use Inviato for illegal, fraudulent, or deceptive purposes
• Send content that is defamatory, obscene, or that infringes third-party rights
• Attempt to circumvent our rate limits or usage policies

You are solely responsible for the content of emails sent through Inviato and for ensuring your outreach complies with applicable anti-spam laws. Polsia provides the infrastructure; you own the content.

Email compliance

You agree that all outbound emails sent using Inviato will include a physical postal address and a clear unsubscribe mechanism. You are responsible for maintaining your email sender reputation. Polsia reserves the right to suspend accounts that generate excessive bounce rates or spam complaints.

Billing and payment

Paid plans are billed monthly in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. If we change pricing for existing subscribers, the new rates apply at your next billing cycle. Failed payments may result in account suspension after 7 days.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide partial refunds for unused subscription time. Upon cancellation, your account data is retained for 30 days and then deleted, unless you request earlier deletion.

Data ownership

You own all prospect data, campaign content, and email copy that you upload to or generate within Inviato. Polsia processes this data on your behalf for the sole purpose of delivering the service. You retain all rights to your data and can export or delete it at any time.

Service availability

We aim for 99.9% uptime but do not guarantee continuous availability. Scheduled maintenance will be announced at least 48 hours in advance. We are not liable for service interruptions beyond our control (force majeure, third-party infrastructure failures).

Intellectual property

Polsia retains ownership of the Inviato platform, its code, design, and trademarks. You receive a limited, non-exclusive, revocable license to use the platform during your subscription. You may not reverse-engineer, copy, or redistribute any part of Inviato.

Third-party services

Inviato integrates with third-party services (Apollo, Hunter, Resend, OpenAI) to deliver its features. These services have their own terms and privacy policies. Polsia is not responsible for the practices of third-party providers.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLSIA IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF INVIATO. OUR TOTAL LIABILITY IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Polsia from any claims, losses, or damages (including legal fees) arising from your use of Inviato, your violation of these Terms, or your violation of any applicable law.

Termination

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in activity that harms Polsia or other users. We will attempt to give 7 days' notice before termination where possible. Upon termination, we will provide you 30 days to export your data.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before taking effect. Continued use of Inviato after changes take effect constitutes acceptance of the new Terms.

Governing law

These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Milan, Italy. If any provision of these Terms is found unenforceable, the remainder continues in full force.
